Description
Order On order of the Court, the application for leave to appeal is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. This ruling, however, is without prejudice to the defendant-appellant's opportunity to ask the Ingham Circuit Court to enforce its November 23, 1987 Opinion and Order, which granted declaratory relief to the defendant-appellant and held in effect that the plaintiffs-appellees are required to pay the withheld benefits that are the subject of this dispute. Since the Ingham Circuit Court's decision has not been reversed or otherwise modified by a higher court, that court is the appropriate place for the defendant to assert his contention that the plaintiffs-appellees are not entitled to bestow upon themselves the benefit of the ""final judgment exception"" in Romein v General Motors Corp, 436 Mich 515, 533, 540 (1990), where the plaintiffs have failed to raise and obtain a favorable ruling on this issue during these proceedings. The motion to delete Michigan Bell Telephone Company as an intervening plaintiff and appellee is considered, and it is GRANTED.
